This notice outlines how your protected health information (PHI) may be used and disclosed. This notice is not a complete list of how we may use your PHI. PHI includes your geographical information, demographic information, email, information of services provided or may provide at our facility, your health benefits, full-face photographs, or any other personal identification information. 

The distribution of your PHI is taken very seriously at SOMA Physical and Occupational Therapy. Please read the following carefully.

Please understand that you have the right to the following:

  • Receive a copy of your PHI
  • Correct your PHI for accuracy
  • Ask us to limit the PHI that we share 
  • Request confidential communications (via phone, email, etc.)
  • Obtain a list of those we shared your PHI with
  • File a complaint if you feel that your rights have been violated
  • Choose who we share your PHI with

We have the right to say “no” to certain requests unless required to by law.

As a company, we may use/share your PHI when: 

  • Treating you
  • Doing research/educational purposes
  • Contacting you (ex: appointment reminders, providing updates, contacting you about your care/coverage, balances, etc.). Please note that standard call and message rates may apply
  • Running the health care organization
    • Support staff will have access to your PHI when coordinating your care and optimizing your experience in our facility.
    • Coordinating with our “business associates”. Our business associates are required to protect your PHI as well.
  • Complying with the law
  • Necessary to address workers compensation, law enforcement and other government entities
  • Legal actions or lawsuits are involved
  • You are not capable of providing us a preference of sharing your PHI during a crisis situation
  • Marketing directly to you (you may unsubscribe from our mailing list at anytime)
  • Contacting other professionals also involved in your care (including their staff)
  • Referring you to another professional (nutritionist, doctor, therapist, etc.) 
  • Billing for your services
  • Assisting with public health and safety concerns (domestic violence, child abuse, illegal activties, contact tracing, etc.)
  • Providing you with nominal gifts

SOMA Physical and Occupational Therapy commits to protecting your PHI to our best possible ability. We commit to contacting you if there is a breach in our electronic medical record system. Please note that your PHI may be incidentally disclosed when using SOMA Physical and Occupational Therapy services. For instance, given the open treatment area, other patients may observe/hear discussions regarding your PHI. The HIPPA Privacy Rule allows for such incidental disclosures. We will contact you if any terms of this notice change.
